The company W.S. Srl shall be hereinafter referred to as "SELLER".
Conditions of Sale
The sales prices shown are in euros including VAT, without taking into account shipping costs. The latter are always borne by the Customer and are invoiced at the time of validation of the order, as a supplement to the selected products. The "SELLER" reserves the right to change prices without notice and to change shipping prices at its discretion, but undertakes to apply the prices in force and explicitly display prices and shipping costs, as indicated on the site, at the time of the order. Any refunds are always made by W.S. Srl through the payment system used to make the purchase, through Paypal, Credit Card, bank transfer both in the case of payment by bank transfer and cash on delivery. Conditions subject to Dl 206/2005.
If you buy with Scalapay you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and that you authorize such assignment.
Shipping times
What happens to your order one moment after you have purchased on www.capuacashmere.it from the "SELLER":
The delivery times of the products vary in consideration of the article ordered by the Customer and the deliverymethods chosen by the same. The times indicated for the delivery terms are merely indicative and are in no way binding for the SELLER. Using express courier transport, the delivery is expected to take 1/5 working days from the moment of the order. In any case, the data sheet of the single product explicitly indicates the estimated delivery time. For products where the data sheet indicates 24/48 hour delivery times, the indications below apply:
A) Day 0 (receipt of order)
the back office processes orders received by 1 p.m., otherwise they are processed the following day. The same applies to orders received on a Saturday, Sunday or public holiday: they will be processed on the first working day following the day the order was placed. The order is processed according to the method of payment chosen:
- if the payment method chosen is PAYPAL or COD, the order will be processed the same day;
- if the method of payment chosen is BANK TRANSFER, the order will be processed when the credit is shown on the bank account of the Company W.S. Srl.
- if the payment method chosen is CREDIT CARD, the order will be processed after 24 hours.
The order is transmitted to our warehouses by 18.00 hours;
B) Day 1 (Courier Forwarder)
on the day following the order, the courier forwarder will collect the goods from our warehouses by 6 p.m. The courier will be given the Accompanying Invoice containing the place of destination and any notes entered in the order. At the same time as collecting the product, an e-mail will be sent to the customer containing the Shipment Number; this will allow the customer to follow the delivery status and estimated times in real time on the Courier Forwarder's website.
C) Day 2 (delivery of goods)
The product will be delivered to the address given when the order is confirmed.
Deliverymethods
1) Standard delivery:
Delivery is made within 5 working days from the date of entrustment to the Courier.
In detail: we deliver within a maximum of 72 hours from when we entrust the courier with the goods. For the whole of Italy, including the islands, the cost of shipping is indicated when the order is placed. In addition, the above-described timeframe for the islands may vary due to unforeseeable factors: for example, adverse weather conditions, etc.
2) Delivery by appointment:
In detail: this option allows the customer to be contacted by the courier at the telephone number he indicates in his order in order to agree on the most convenient day and time for delivery.
3) Delivery to the floor:
In detail: this option allows the customer to receive the ordered products on the desired floor.
Cost of Transport:
The cost of transport is determined by the courier and depends on the weight and/or volume of the package(s) purchased by the customer. As described above, there are additional (extra) services such as delivery by appointment and delivery to the floor.
The Invoice
The Invoice must be requested at the time of ordering and is inserted at the time of shipment inside a transparent envelope which is attached to the outside of the package. The customer may, however, request a copy by sending an email to ordini@capuacashmere.it. The Invoice must be kept with care, as it is the valid document for the product warranty. The invoice for the purchased goods is issued by the "SELLER".
Refunds
Customers will have as a single point of contact for any complaint or for any problem related to both the order phase and the after-sales phase W.S. Srl, the same is equipped with all the tools to manage both through Call Center and through messaging systems active 24/24 to analyze the problems and seek a solution to the problems of the individual customer. Any refunds are made by W.S. Srl through the payment system used to make the purchase, through Paypal, Credit Card, bank transfer in the case of payment by bank transfer or cash on delivery. Refunds will be made within and no later than 10 working days.
Evasion of Orders
W.S. Srl, in order to ensure proper service to its customers, guarantees the receipt and acceptance of purchase orders until 5.00 p.m. from Monday to Friday; orders received after that time, as well as those received on Saturday, Sunday or any other holiday, shall be considered received on the first working day after the order itself. Any reductions in working hours and/or interruptions in sales services in particular periods of the year (e.g. summer months) that could lead to longer delivery times shall be adequately highlighted at the time the order is placed, and it shall be at the Customer's discretion whether or not to confirm the order according to the times indicated. At the time of delivery of the goods, the Customer is required to check:
- that the number of packages delivered corresponds to the number indicated in the transport document
- that the packaging is intact and not altered, including the closing tapes
In the event of tampering and/or breakage, the Customer shall immediately dispute the shipment and/or delivery by writing "RESERVE FOR DAMAGED PACKAGE" on the copy of the delivery document to be returned signed to the courier or other operator.
The Customer shall report any damage within 7 days of receipt of the goods by registered letter in advance or by e-mail to the following addresses:

For each order, the Customer is required to specify at least one telephone number to allow the express courier to contact him in the event of delivery difficulties; if the delivery is not successful for reasons not attributable to W.S. Srl, or to the express courier for more than 5 consecutive days, the order shall be considered cancelled and the Customer will be charged for the storage costs as quantified by the express courier.
Guarantees
All the products sold by the "SELLER". are covered by the conventional manufacturer's warranty and by the 24-month warranty for conformity defects, pursuant to DL 24/2002. To benefit from the assistance under warranty, the Customer shall keep the invoice (or the transport document) which he will receive by e-mail in PDF format. The manufacturer's conventional warranty is provided in accordance with the procedures illustrated in the documentation inside the product packaging. Please note that the 24-month warranty is reserved for the private consumer (a person who buys goods for purposes not related to his professional activity, or making a purchase without indicating a VAT number on the order form). If, following the intervention of an Authorized Assistance Centre, the defect is not covered by the manufacturer's conventional warranty, the Customer shall be charged with any costs of verification and restoration required by the Authorized Assistance, as well as the costs of transport, if incurred by the "SELLER".
It is specified that "SELLER" cannot be held responsible in any case for the activity of the technical assistance centres on the products: any delays in repairs and/or any replacements, and/or failure to recognise by the authorised technical assistance centre the operating defect, as provided for by DL n. 24/2002, and/or any other hypothesis considered prejudicial to the Customer, are to be attributed exclusively to the Manufacturers' policies.
In cases where the application of the warranties provides for the return of the product, the goods must be returned by the Customer in their original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, intact consumables, manuals, cables, etc. ...); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; it should be avoided in all cases the attachment of labels or adhesive tapes directly on the original product packaging.
All shipments of products will be returned to the Sender, at the Sender's expense:
- Not including original packaging, accessories and manuals
- Received with unsuitable or inadequate outer packaging and therefore damaged during transport: the Warranty does not cover damage due to failure to use the original packaging and adequate external protective safety packaging not authorised by the service centre.
The intervention under Warranty on Hard Disks or various storage devices excludes any saving of data belonging to the Customer or uninstalling of Software. "SELLER" shall not be responsible for the loss of data on the product being serviced.
Any right of the Customer to damages or compensation as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property is hereby excluded.
Transport Insurance
Upon receipt of your package, you should check that the carrier's packaging is intact and not cut and/or tampered with. If this is not the case, it is likely that the package has been opened during shipment and that the contents have been stolen.
If you accept a tampered parcel, there is no possibility of making a claim.
So we repeat: before accepting the package, you should check its integrity.
In the event of suspected tampering or a missing parcel, the goods may be accepted subject to a specific reservation (indicate the reason). The customer must report any damage within 7 days of receipt of the goods. We inform that according to the Legislative Decree 22/5/1999 n. 185, the goods travel at the risk and danger of the addressee, W.S. Srl, and "SELLER" is not responsible for any theft or damage.
For the sake of completeness, here is an extract from the decree-law regulating this subject:
EXTRACT FROM LEGISLATIVE DECREE 22/5/1999 no. 185 ON CONTRACTS CONCLUDED AT A DISTANCE "Commercial relations of sale are regulated by these conditions of sale as per current Italian legislation. The Supplier shall make shipments to the Customer with selected express couriers and the goods shall travel carriage paid, with the costs and risks of transport borne entirely by the Customer. These costs and any other charges connected with the transport and/or shipment of the products are calculated and detailed in the order confirmation and purchase invoice. Upon receipt of the goods at their home address, the Customer must check the integrity of the packages. In the event of discrepancies and/or differences, it shall be the responsibility of the Customer to refuse the parcel under penalty of forfeiture of the right to assert his rights in this regard".
Right of withdrawal
"SELLER" acknowledges the right of withdrawal:
Pursuant to Legislative Decree 206/2005, if the customer is a consumer (i.e. a natural person who purchases goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to W.S. Srl a VAT number), he is entitled to withdraw from the purchase contract for any reason, without explanation and without penalty. The product must be returned in respect of resaleabilitỳ (undamaged, never used and complete with the original packaging and all original product accessories).
The Customer shall give notice of this within 14 working days from the date of delivery of the goods, by e-mail or registered letter to the following addresses:

Upon receipt of the registered letter, we will provide the exact return address of the product.
Goods returned without authorisation will be automatically rejected.
In addition to the wish to exercise the right of withdrawal, it is essential to indicate in the same communication the details of a bank or post office account for the purpose of re-crediting the amount due (CIN Code, ABI Code, CAB Code, Account Number, Account Holder). For the correct recognition of the right of withdrawal, we specify that:
- The product must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, consumables intact, manuals, cables, etc. ...); to limit damage to the original package, we recommend, when possible, to put it in a second box; it should be avoided in all cases the attachment of labels or adhesive tapes directly on the original product packaging
- The product must be returned within the time limits and in the manner described above to the address that will be indicated by W.S. Srl.
- W.S. Srl is responsible for return shipping costs if the return is made within the first 7 days of receipt of the goods. Beyond 7 days, shipping costs will always be borne by the customer
W.S. Srl reserves the right to check the returned goods to assess any damage or tampering not resulting from transport.
In the event that the right of withdrawal is exercised, the Customer will be reimbursed in full for the amounts paid for the purchase of the product, including delivery costs incurred, and will be refunded within and no later than 14 days from receipt of the order withdrawal notice, exclusively by bank transfer. In the event that the user opts for the replacement of the product, the cost of sending the new product will be borne by the user.
Applicable law
The contract of sale between the Customer and the "SELLER" is understood to be concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes deriving from the conclusion of the present contract of sale at a distance, the territorial jurisdiction is exclusively that of the Court of [CITY].
Contract of sale
"SELLER" accepts orders with delivery to be made exclusively within the Italian territory.
"The SELLER shall issue an invoice, enclosing it with the product to be delivered.
The "SELLER" shall include in the above-mentioned invoice only the data provided by the customer, stating that no changes will be allowed after the invoice has been issued.
The customer may only purchase the products, as per the electronic catalogue on the website www.capuacashmere.it existing at the time the order is sent. In this regard, W.S. Srl informs the customer that the images and technical data, none excluded and/or excepted, accompanying the product sheet on display must not be considered by the customer as complete and exhaustive of the characteristics but may, therefore, be different in size, colour and accessories or other.
For all that has been communicated and accepted by the customer up to this point, no responsibility canbe attributed, for any reason and/or title, to W.S. Srl.
The correct receipt of the order is confirmed by W.S. Srl by means of an e-mail reply, sent exclusively to the e-mail address communicated by the customer. This confirmation message will propose all the data entered by the customer who agrees to verify the correctness and communicate, no later than 2 days, any correction. Only afterwards W.S. Srl, having verified the actual availability of the goods as well as the correctness of the customer's data, shall send by e-mail the final acceptance of the contract, which only from this moment shall be considered concluded and stipulated between the parties to all legal effects.
By placing an order on the W.S. Srl website, the customer declares that he/she has read the sales conditions, the payment methods proposed as well as the entire purchase procedure and also declares that he/she accepts them without reservation and that he/she has received exhaustive information on the subject. Furthermore, with express reference to Articles 3 and 4 of Legislative Decree 185/89, the customer will receive, via e-mail, all the information necessary for the identification of the seller, which the customer is obliged to keep together with the e-mail of acceptance of the contract.
In the event that the customer should return, for legitimate reasons, the purchased products, he must provide for the shipment within the established terms and exclusively at the registered office of W.S. Srl.
